Bases
1. This authorization is only to subdivide
the property as The Company is planning to do a rustic country development ( fraccionamiento rustico campestre.) IT
IS STRICTLY FORBIDEN TO DO ANY ACTIVITY OTHER THAN SUBDIVIDING.
·
The area of each
lot that can be developed is a maximum of 35%.
·
The area between
the street and the usable (developable) area can be more than 5 meters.
·
The area from the
dune crest to 20 meters inland cannot be developed.
·
The only
permissible activity is the subdivision and marking of lots and the marking of
the usable (developable) area.
·
Each project is
authorized to construct two beach accesses. They must be made of wood and of
stilt construction (above the ground).
·
Water and
electricity can only be introduced through the existing street. This existing
street cannot be paved; it must remain a dirt or stone road.
2. The projects have 6 months within which to
complete marking of lots. Etc.
3.
In the event
that an owner decides to exceed the authorized activity and build on the lot,
s/he must individually present an environmental impact study as
well as a construction project. This must be done FOR EACH LOT. (includes points 4, 5, and 6)
CONDITIONS
·
The Company
cannot engage in any construction or the removal/destruction of any plant or
the modification of the topography of the dunes unless/until IT HAS THE
PROPER AUTHORIZATION FOR EACH LOT.
·
If any
animals are found when cleaning the area for construction The Company must
rescue them.
·
The company must
have a record, with photos, of all the animals that it rescues.
·
While engaged in
subdividing the property or in construction, The Company must guarantee one
toilet per every 15 people, and must dispose of the residue in the closest
water treatment plant (La Paz).
·
While engaged in
any authorized activities on the land, The Company must provide free transit
for the local fauna.
·
The Company must
dispose properly of all the garbage and residue according to the instructions
of the municipal government.
·
Any machine or
motor vehicle that works on the project must pass the gas emissions
test according to the NOM-041 standard.
·
It’s forbidden to
do any maintenance (change of oil) or mechanical assistance of any machinery in
the zone of the project or any place closer than 100mt from any arroyo or body
of water.
·
The machinery
cannot produce noise pollution.
IT IS STRICTLY FORBIDDEN TO:
·
Burn any
material.
·
Open any new sand
mines or material banks.
·
Discharge or
infiltrate black or residual (organic or inorganic) waters to the ground (soap,
toilet, fertilizers)
·
To introduce any
non-native plants.
·
Plants that are
removed must be integrated in the ground to fertilize it.
·
Deny access to
the beach through the correct walkways.
·
Use insecticides.
·
Build walls or fences
that can change or block the wind patterns in the dune crests and between the
lots.
·
Transit motor
vehicles on the dunes and beaches.
·
Install lights
that can be seen from the beach.
·
Flatten or touch
any land that is outside the area that can be used for building .
·
Dirt fillings,
only compensations.
·
Go to the
bathroom outside.
In case the beach by the project is used for turtle
arrivals The Company must provide the viability of this species by the
following actions:
·
The Company must
name a person with enough technical and biological capacity to be responsible
to coordinate with SEMARNAT.
·
The Company must
make a station for observing and caring for the turtles inside the installation
of the project.
·
It’s forbidden to install electric or gas
lights on the beach or in any place close to 100 meters from the high
tide line.
·
The lights that
are permitted are candles and kerosene lamps. These can be used no more than 4
hours after sunset. This light must not
be oriented to the beach and must have protection from reflection towards the
beach.
·
During the months
of the turtle arrivals, ALL tourism or recreational activities must be canceled
on the beach.
·
It’s forbidden to
use a motorboat.
·
It’s forbidden to
use latrines and/or septic tanks, in any area of the project,
especially on the beach. Water treatment plants must be built instead.
·
The Company must
collaborate and help investigation centers and scientists to conserve the
turtles.
·
It’s forbidden to
catch, track, bother, follow, hunt, collect, and/or damage any specie of local
flora and fauna.
·
The Company must
provide logistics to SEMARNAT representatives working for the protection of the
sea turtles.
IT IS STRICTLY FORBIDDEN TO
·
Put lights on or
near the beach.
·
Spill oil,
gasoline, combustibles, hydrocarbons or any other chemical product from motor
machinery.
·
Have fires on the
beach.
·
Throw garbage or
residue in the ocean.
When The Company sells
or changes owners it must transfer all the obligations to the new owners.
If any of these points
are not fulfilled SEMARNAT can and will take the permits away.
